Withdrawal instructions

The following withdrawal instructions are addressed exclusively to consumers within the meaning of § 13 of the German Civil Code (Bürgerliches Gesetzbuch, BGB). Accordingly, a consumer is any natural person who enters into a legal transaction for purposes that can be attributed neither to their commercial nor to their independent professional activity:

Withdrawal/return/exchange of fabrics, cushions and parasol canopy fabrics.

We must inform you that every order of fabrics and cushions constitutes a custom-made item produced to your wishes. In the past, orders have unfortunately often been subject to deviations, as the colours in the photographic representation in the online shop sometimes differ from the actual colours of the original. Please therefore be sure to request original fabric samples in order to be completely certain of making the right choice — with regard to both material and colour. Orders placed without requesting original fabric samples are therefore excluded from withdrawal, return or exchange. This also applies to the canopy fabric of parasols with regard to the material and the fabric colour. We will be happy to send you a fabric selection free of charge in advance.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have or has taken possession of the goods.

To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct costs of returning goods that can be sent as a parcel. You also bear the direct costs of returning goods that cannot be sent as a parcel. The costs are estimated at a maximum of approximately 500 EUR.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Unless otherwise provided, the right of withdrawal does not exist in the case of distance contracts for the supply of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.
